Terms of Service

1. Acceptance of Terms

By accessing or using Flash-n-Frame at flashnframe.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Flash-n-Frame is a web application that uses artificial intelligence to generate infographics, analyze code repositories, and edit images. The Service integrates with third-party AI providers (Google Gemini, OpenAI, Anthropic, xAI) to process your requests.

3. User Accounts

You must sign in via Google, GitHub, Microsoft OAuth, email/password, or magic link to access authenticated features.
You are responsible for maintaining the security of your account. Do not share your access credentials.
You must be at least 13 years of age to use the Service.
We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree NOT to use the Service to:

Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Generate content that infringes on intellectual property rights of others
Attempt to bypass rate limits, authentication, or other security measures
Use automated tools (bots, scrapers) to access the Service without permission
Reverse engineer, decompile, or attempt to extract source code from the Service
Interfere with or disrupt the Service or servers connected to the Service
Use the Service to compete directly with Flash-n-Frame

5. AI-Generated Content

Content generated by AI providers through the Service is provided "as is." We do not guarantee the accuracy, completeness, or suitability of AI-generated content.
You are responsible for reviewing and verifying all AI-generated content before using it for any purpose.
AI-generated content may be subject to the terms of the underlying AI provider (Google, OpenAI, Anthropic, xAI). You agree to comply with their respective usage policies.
You retain ownership of the prompts and inputs you provide. Ownership of AI-generated outputs is subject to the policies of the AI provider used.

6. User Content

You retain ownership of content you upload to the Service (images, text, data).
By uploading content, you grant us a limited license to store, process, and display the content as necessary to provide the Service to you.
You represent that you have the right to upload any content you submit and that it does not violate any third party's rights.
Uploaded images are stored in Cloudflare R2 and scoped to your user account. We do not share your uploaded content with other users.

7. Rate Limits and Fair Use

The Service implements rate limiting to ensure fair access for all users. Current limits include:

AI generation: 20 requests per minute
Image uploads: 10 per minute
GitHub API: 30 requests per minute

Exceeding these limits will result in temporary throttling (HTTP 429). Persistent abuse may result in account suspension.

8. Third-Party Services

The Service relies on third-party providers including Supabase, Cloudflare, Google, OpenAI, Anthropic, xAI, Upstash, and GitHub. We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of features powered by these services is also subject to their respective terms of service.

9. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by Flash-n-Frame and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLASH-N-FRAME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

12. Indemnification

You agree to indemnify and hold harmless Flash-n-Frame and its operators from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 10, 11, and 12 survive termination.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
